0. Overview
These Terms and Conditions ("Terms") together with the Quotation ("Quote") form a binding agreement ("Agreement") between Platinum Solar Designs Pty Ltd ("PSD", "we", "us", "our", "Company") and you (the person or entity named in the Quote). They apply to the supply and installation of solar photovoltaic (PV) systems and/or battery storage systems. Please read them carefully.
1. Quote Validity
The Quote is valid for 30 days from the date of issue unless extended in writing by us.
2. Parties & Definitions
Agreement — The contract consisting of the Quote and these Terms.
Battery System — The battery energy-storage equipment (and associated hardware, software & cabling) specified in the Quote.
Completion — Commissioning of the System and demonstration of operational availability, excluding minor defects not affecting performance that will be rectified as soon as practicable.
Deposit — The upfront amount (if any) specified in the Quote.
Existing System — A PV system at the Property that was not originally supplied or installed by PSD.
Federal Battery Rebate — A financial incentive available under the Cheaper Home Batteries Program (or any successor scheme) administered by the Australian Government.
Force Majeure Event — An event beyond our reasonable control.
Grid Connection — The process of obtaining distributor/retailer approval, upgrading metering and energising the System.
Installation — Standard installation work required to supply, mount, wire, test and commission the System.
3. Consent of Authorising Party
By accepting the Quote you warrant that you are the owner of the Property or are duly authorised by the owner(s), and that all co-owners consent to the Installation. The Quote includes pricing, payment schedule and a site-specific design & performance estimate. We recommend you confirm any tariff changes with your electricity retailer before and after installation.
4. Pricing
Prices are based on a Standard Installation. If unforeseen factors make the job Non-Standard (e.g. switchboard upgrade, inaccessible roof, structural issues), we will quote additional costs for your approval before proceeding. Prices exclude any distributor or retailer fees (e.g. meter upgrade). If a price increase becomes necessary, we will notify you in writing. You may accept the new price or cancel within 28 days and receive a full refund of monies paid.
5. Payment
A Deposit of 10% of the Total Payable (excluding residential PV and battery jobs) is due on acceptance. You may cancel within 10 business days (cool-off) for a full refund. The balance is due strictly in accordance with the payment schedule in the Quote. Ownership of the System passes only when payment is received in full. Late payments attract interest at the NSW court-ordered rate for judgment debts plus reasonable recovery costs.
6. Federal Battery Rebate & Renewable-Energy Certificates
Where your Battery System is eligible, PSD will (unless you opt out) apply for the Federal Battery Rebate on your behalf and deduct the estimated rebate amount from the Total Payable. You authorise PSD to collect, use and disclose the personal information required to lodge the rebate claim and to receive the rebate proceeds. The Rebate Discount is based on information current at the Quote date. If the rebate value or eligibility rules change before Completion, PSD will notify you and adjust pricing or provide alternative options.
7. Authority to Install & Approvals
You are responsible for any local planning or heritage approvals unless otherwise stated in the Quote. We will prepare and lodge the distributor Grid-Connection application. If approval is refused, the Agreement is cancelled and all monies refunded.
8. Access & Installation
You must provide safe, unobstructed access, including weekend or public-holiday work if required. PSD installers are suitably licensed and (where applicable) Clean Energy Council accredited. Estimated installation dates are indicative only. We will keep you informed and reschedule if delayed by weather, supply or other factors.
9. Retrofit & DC-Coupled Battery Installations
Where the Battery System is DC-coupled to an Existing System (i.e. PV equipment not supplied or installed by PSD): PSD will exercise due care during installation but accepts no liability, and provides no warranty support, for any pre-existing solar inverters, panels, mounting structures, cabling or other components. Any faults traced to the Existing System are outside the scope of this Agreement. Manufacturer warranties for the Battery System remain unaffected.
10. Grid Connection & Metering
Within 48 hours of Completion PSD will submit metering paperwork to your retailer/distributor. Retailer metering charges are payable by you. We recommend confirming fees and post-solar tariff changes prior to acceptance.
11. Our Right to Terminate
We may terminate if (a) you breach these Terms and fail to remedy within 7 days; or (b) you sell the Property prior to Completion.
12. Your Right to Terminate
You may terminate and receive a full refund if: the final design differs materially and you do not approve it; installation is unreasonably delayed for reasons within our control and you do not accept a revised schedule; grid-connection approval is not obtained or is refused; additional chargeable work (not in the Quote) arises and you do not consent to the extra cost.
13. Defects & Warranty
PSD Retailer Warranty: 5 years on supplied equipment & workmanship, 10 years on installation labour (roof penetrations, cabling, mounting). Response target: within 14 days of notification.
Battery & Inverter Manufacturer Warranties: Supplied separately; typically 10 years product & performance for batteries, 10–15 years for inverters. Normal fair wear & tear is covered unless it does not impact performance. The warranty is void if unauthorised persons modify or repair the System. Warranty is transferable while the System remains at the original Property. PSD is not liable for lost feed-in income during downtime.
14. Liability
To the fullest extent permitted by law, PSD's liability is limited to repair or replacement of defective parts or (at our option) a refund of the purchase price proportionate to the defect. Nothing in these Terms limits statutory consumer rights that cannot be excluded.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our control (e.g. natural disasters, supply chain disruption, government action). Timeframes are extended accordingly.
16. Complaints
Please email info@platinumsolardesigns.com.au or write to Complaints Manager, PSD. We will acknowledge receipt within 7 days and aim to attend or resolve within 14 days.
17. Privacy & Marketing Consent
We collect, use and disclose personal information to deliver the System, process rebates and for limited marketing consistent with the Privacy Act 1988 & Spam Act 2003. You may opt-out of marketing at any time.
18. Documentation
On commissioning we will provide manuals, warranty certificates, compliance certificates and shutdown procedures.
19. Governing Law
This Agreement is governed by the laws of New South Wales, Queensland and the Australian Capital Territory.
Performance & Financial Disclaimer
